Supreme Court reinstates Havana Docks litigation against major cruise lines over Cuban port use
The U.S. Supreme Court reversed an appellate decision in an 8–1 ruling, allowing Havana Docks Corporation to proceed with litigation against Carnival, Norwegian, Royal Caribbean, and MSC over cruise port operations in Havana between 2016 and 2019. The court held that liability under the Helms-Burton Act of 1996 turns on use of confiscated property itself rather than the hypothetical continuation of an expired concession. Lower courts had initially awarded damages exceeding US$400 million, later overturned on appeal.
